1) Who We Are

The Coverage Brief (“we,” “us,” “our”) operates an informational website and publishing platform available at TheCoverageBrief.com (the “Site”). These Terms & Conditions (“Terms”) govern your use of the Site and any related features, including newsletter subscriptions and contact/request forms.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2) Important Disclosures: We Are Not an Insurance Company

The Coverage Brief is not an insurance carrier, does not underwrite insurance, and does not issue policies. We do not bind coverage. We do not guarantee eligibility, pricing, or availability of any insurance product.

Information on the Site is educational and general in nature and may not reflect current carrier underwriting rules, state requirements, or policy forms.

3) No Professional Advice

The content provided on the Site is for general informational purposes only and is not legal, financial, accounting, tax, or individualized insurance advice. You should consult a qualified professional for advice specific to your situation.

4) Referrals / “Connect With a Licensed Professional”

If you submit a request through the Site (for example, a “get connected” or “request contact” form), you are asking us to help route your request to one or more third-party licensed insurance professionals or service providers (“Third-Party Providers”).

We do not control Third-Party Providers and do not guarantee:

  • that you will be contacted,

  • the timing of any contact,

  • any quote, premium, coverage terms, or underwriting outcome,

  • that a specific product will be available to you.

Any relationship you form with a Third-Party Provider is between you and that provider. Their services may be subject to separate terms, privacy policies, and licensing requirements.

5) User Submissions and Accuracy

When you submit information through the Site, you agree that:

  • you are providing accurate, current information to the best of your knowledge,

  • you will not submit false information or impersonate another person,

  • you will not submit sensitive data you do not want shared for referral purposes.

You understand that incomplete or inaccurate information can lead to incorrect general guidance or misrouted requests.

6) Communications Consent (Email, Calls, SMS) – TCPA/Telemarketing

If you provide a phone number, email address, or other contact method, you consent to be contacted about your request.

For SMS/Text and Phone Calls: By submitting your information, you provide express permission for us and/or Third-Party Providers to contact you at the number you provide, which may include calls or texts using automated technology where permitted by law.

  • Message and data rates may apply.

  • Message frequency varies.

  • You can opt out of texts by replying STOP (or following the instructions provided in the message).

  • Consent is not a condition of purchase.

If you do not want calls or texts, do not provide your phone number and do not submit a contact request.

7) Advertising, Affiliates, and Editorial Independence

The Site may include ads, sponsorships, affiliate links, or paid placements. If you click affiliate links and make a purchase, we may earn a commission. Editorial content may be created independently, and we strive to label sponsored content where applicable.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • content is error-free, complete, or current,

  • access will be uninterrupted,

  • the Site will be secure or free of harmful components.

12) Limitation of Liability

To the maximum extent permitted by law, The Coverage Brief will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the Site.

If we are found liable for any reason, our total liability will not exceed the greater of:

  • $100, or

  • the amount you paid us (if any) in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13) Indemnification

You agree to indemnify and hold harmless The Coverage Brief from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • your misuse of the Site,

  • your violation of these Terms,

  • your violation of any law or third-party rights,

  • your content submissions.

14) Dispute Resolution

Optional Arbitration Clause (stronger litigation shield):
If you want maximum legal shielding, you can include this section. If you’re unsure, leave it out until a lawyer reviews it.

Binding Arbitration & Class Action Waiver:
Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration on an individual basis, and not in a class, consolidated, or representative action, except where prohibited by law. The arbitration will be conducted in Lee County, Florida (or another mutually agreed location) under the rules of a recognized arbitration provider. Either party may seek injunctive relief in court for intellectual property misuse.

(If you keep arbitration, I’ll tailor the provider/rules once you tell me your preference.)

15) Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. If arbitration is not used or not permitted, you agree to venue in state or federal courts located in Florida, subject to applicable law.

16) Changes to These Terms

We may update these Terms from time to time. The “Effective Date” will reflect the latest update. Continued use of the Site after changes means you accept the updated Terms.
